SMS & RCS Consent Policy
Purpose
This SMS & RCS Consent Policy outlines how HealthCare Partners (“HCP,” “we,” “our,” or “us”) uses SMS (Short Message Service) and RCS (Rich Communication Services) text messaging to communicate with patients. It describes the types of messages we may send, how consent is obtained, and how patients can manage their preferences.
Types of Communications
With patient consent, HCP may send text messages related to:
- Reminders that your healthcare provider has requested to schedule an appointment
- Notifications for medications ready for pickup
- Alerts for required lab work (excluding sensitive information)
- Reminders for upcoming prescription refills
- Requests for pharmacist consultation
- Follow-up request to return call to healthcare provider after unsuccessful phone outreach
You are not required to opt in as a condition of receiving care. Participation is voluntary. However, opting out may prevent us from sending you timely updates regarding your care. We do not send promotional or marketing messages via SMS or RCS without your explicit written consent.
Consent
By providing a mobile number and opting in to receive messages from HCP, you express consent to receive text messages as described above. Consent is not a condition of receiving care. You may provide consent via an existing or dedicated form, verbally, or via text. Regardless of mechanism, consent collection will include: the HCP brand name, program description, cost disclosure, message frequency disclosure, a statement that consent data will not be shared with third parties for marketing or promotional purposes, opt-out (STOP) and help (HELP) instructions, links to this Policy and our Terms of Use, and an explicit opt-in statement with your name/signature or affirmative reply.
Welcome Confirmation
Once you opt in, HCP will send a confirmation “welcome” text
“Welcome to HealthCare Partners text communications. Msg & data rates may apply. Message frequency varies. You can text STOP at any time to opt out. Text HELP for help.”
Message Frequency and Costs
Message frequency may vary depending on patient needs and appointments. Message and data rates may apply. HCP is not responsible for any charges incurred from text messaging.
Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Opting Out and Help
You may opt out of receiving text messages at any time by replying STOP. You will receive a final confirmation text to verify you have opted out, after which no further messages will be sent. To rejoin, you may text START to the same number or contact HCP directly. For help, reply HELP or contact us at (800) 877-7587 or ehcpcustomerservice@hcpipa.com.
Privacy and Security
Your privacy is a priority. Your mobile number will not be sold or shared with third parties or affiliates for marketing or promotional purposes, and will not be shared beyond service providers directly involved in delivering messages (such as messaging vendors and telecom providers). We will not use your number for unrelated marketing without your express written consent.
Text messages sent via SMS and RCS channels are not fully secure and may not be HIPAA-compliant. We take reasonable precautions to safeguard your privacy by restricting the content of these messages to non-sensitive notifications, and we do not include highly sensitive Protected Health Information (PHI) in SMS or RCS messages. HCP otherwise protects patient data in compliance with HIPAA and applicable federal and state laws.
